This policy is a contract between Horizon and you, the end-user. This document is a legal contract between Horizon and you, defining your legal rights and obligations, as well as those of Horizon, the owner of Horizon, in relation to the Horizon websites and the services offered by Horizon. All use of Horizon and all associated services is subject to the following terms and conditions. By accessing and browsing Horizon and all related services, you agree to these terms and conditions.

Scope

This policy applies to Horizon.Pics and hrzn.bio only. Other services have their own terms and conditions documents that do not apply to Horizon.Pics or hrzn.bio.

User Content

We do not own any data, information, or material (collectively, "Content") that you submit on the Website in the course of using the Service. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content. Unless specifically permitted by you, your use of the Website and Services does not grant us the license to use, reproduce, adapt, modify, publish, or distribute the Content created by you or stored in your user account for commercial, marketing, or any similar purpose.

Adult Content

Please be aware that there may be certain adult or mature content available on the Website. Where there is mature or adult content, individuals who are less than 18 years of age or are not permitted to access such content under the laws of any applicable jurisdiction may not access such content. Certain areas of the Website and Services may not be available to children under 18 under any circumstances.

Horizon provides its services and platforms on an "as is, available" basis without warranty of any kind. Horizon does not guarantee the continuous availability of its services; however, we will try our best to ensure that the services are available.

No Rendering of Advice

Horizon and its licensors own all the intellectual property rights in the Website and the Services. You may not copy, reproduce, republish, upload, post, transmit, distribute, or in any way exploit any of the Website or Services, except as expressly permitted by Horizon in this policy. You may not modify, adapt, translate, create derivative works from, or otherwise exploit any of the Website or Services, except as expressly permitted by Horizon in this policy. You may not use the Website or Services to transmit, or facilitate any transmission of, any material that is libelous, defamatory, or otherwise unlawful, or that infringes any patent, trademark, trade secret.

Abuse

Horizon does not condone the abuse of its platforms. If you find abusive material being hosted on Horizon, please contact contact@horizon.pics immediately with the necessary details.

Prohibited Uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the Website and Services or Content:

  • (a) for any unlawful purpose;
  • (b) to solicit others to perform or participate in any unlawful acts;
  • (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
  • (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
  • (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  • (f) to submit false or misleading information;
  • (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Website and Services, third-party products and services, or the Internet;
  • (h) to spam, phish, harm, pretext, spider, crawl, or scrape;
  • (i) for any obscene or immoral purpose; or
  • (j) to interfere with or circumvent the security features of the Website and Services, third-party products and services, or the Internet. We reserve the right to terminate your use of the Website and Services for violating any of the prohibited uses.

Limitation of Liability

WHERE APPLICABLE BY LAW, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, WILL HORIZON.PICS OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD-PARTY PARTNERS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, RELIANCE, OR EXEMPLARY DAMAGES (INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM ANY UNSUCCESSFUL COURT ACTION OR LEGAL DISPUTE, LOST BUSINESS, LOST REVENUES, OR LOSS OF ANTICIPATED PROFITS OR ANY OTHER PECUNIARY OR NON-PECUNIARY LOSS OR DAMAGE OF ANY NATURE WHATSOEVER) ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THAT RESULT FROM YOUR USE OF OR YOUR INABILITY TO USE THE SERVICE, OR ANY OTHER INTERACTIONS WITH HORIZON.PICS.

Indemnification

You agree to indemnify and hold the Operator and its affiliates, directors, officers, employees, agents, suppliers, and licensors harmless from and against any liabilities, losses, damages, or costs, including reasonable attorneys' fees, incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Website and Services, or any willful misconduct on your part.

Severability

All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid, or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.

Product Delivery

Access to Horizon's services and platforms is usually instant, but may take up to 15 minutes for certain features. Horizon does not guarantee any timeframe for product delivery.

Changes

We reserve the right to modify this Agreement or its terms relating to the Website and Services at any time, effective upon posting of an updated version of this Agreement on the Website. When we do, we will revise the updated date at the bottom of this page. Continued use of the Website and Services after any such changes shall constitute your consent to such changes.

Disclaimer of Warranties

The services and all materials contained on the website are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Horizon does not warrant that the services will be uninterrupted, timely, secure, or error-free, or that any defects in the services will be corrected.

Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of Quebec, Canada, without regard to its conflict of law principles. Any disputes arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada.

Arbitration

Any controversy or claim arising out of or relating to this agreement or the breach thereof shall be settled by binding arbitration in accordance with the rules of arbitration applicable in Quebec, Canada. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Termination

We reserve the right to terminate your access to the website and services, without any advance notice, if you breach any of the terms and conditions of this agreement. Upon termination, your right to use the website and services will cease immediately.

Limitation on Time to File Claims

Any cause of action or claim you may have arising out of or relating to these terms and conditions or the website and services must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.

Data Protection and Privacy

We are committed to protecting your privacy and ensuring the security of your personal data. Our use of your personal data is governed by our Privacy Policy, which forms an integral part of these terms and conditions. By using our website and services, you consent to the collection, use, and disclosure of your personal data as described in our Privacy Policy.
